$5 Million New York City Nursing Home Neglect Verdict

On December 12, 2019, a New York City nursing home neglect jury returned its verdict in the amount of $5,032,281 ($2,980,281 awarded in compensatory damages and an additional $2,052,000 in statutory interest) against a New York City nursing home for its alleged neglect of an elderly resident that ultimately resulted in his death.

Before the jury retired to deliberate the amount of damages, the trial judge determined that the defendant nursing home was negligent in ignoring the resident’s medical needs and further determined that the nursing home’s neglect was the cause of the resident’s brain damage that resulted in his death.

The plaintiff’s nursing home neglect lawsuit alleged that the 75-year-old resident was often left alone for hours in his room and that the nursing home staff failed to provide adequate and necessary care to meet his medical needs. As a result of failing to timely and properly monitor the resident’s blood sugar levels, the resident often suffered low blood sugar levels that left him lethargic and in hypoglycemic shock. The nursing home complaint further alleged that the nursing home compounded its lack of appropriate care and treatment by failing to timely call for an ambulance to transport the resident to the hospital for treatment after he became unresponsive for hours.

The nursing home complaint alleged that as a result, the resident suffered lack of oxygen to his brain that led to permanent and severe brain damage. The resident remained in a coma and unresponsive, being provided nutrition by a feeding tube, for six miserable months before he died.

The resident’s widow stated after the verdict, “Fred would give the shirt off of his back to anyone who needed help. This tragedy could have been prevented if Northern Manhattan Nursing Home did their job. I am just so happy there is finally some justice and this jury was held accountable for neglecting my husband.”
