Medical Malpractice Cases In New York – Official Administrative Statistics

The New York State Department of Health Board for Professional Medical Conduct,  which investigates complaints made against physicians, physician assistants and specialist assistants and prosecutes those charged with misconduct, reported in its Annual Report for 2008-2009 that there were 9,103 complaints received during 2009, which represented a 24% increase in complaints (an all-time high) from five years prior (complaints increased each of the prior five years). Nonetheless, the average time to complete an investigation remained less than one year.

Despite the completion of investigations into 9,490 complaints during 2009, a total of only 275 actions were taken during 2009, a reduction from each of the prior two years (the number of license revocations, surrenders, and actual suspensions were less in 2009 than in each of the prior two years). Actions taken in 2009 for medical negligence/incompetence were less than in each of the prior two years.

Just over half of the complaints were received from the public, and an additional 16% involved allegations of medical malpractice.  Only 2% of the complaints were received from physicians.

New York took more serious actions than any other state in the nation, including loss of license actions (215), in 2008. New York ranked nineteenth  in the nation in the number of serious disciplinary actions taken, with 3.73 actions per 1,000 physicians, for the period 2006-2008.
