Medical Malpractice Cases in Maryland – Official Administrative Statistics

The Maryland Board of Physicians is responsible for licensing and disciplining physicians and other health practitioners in Maryland. In its Annual Report to the Maryland Legislative Policy Committe for fiscal year 2009 the Board reported that during fiscal year 2009 it opened investigations on 902 physician licensees and the total allegations against the physicians were 1169 (including 502 allegations involving immoral or unprofessional conduct in the practice of medicine and 376 allegations involving failures to meet appropriate standards as determined by appropriate peer review for the delivery of quality medical and surgical care performed in an outpatient surgical facility, office, hospital, or any other location in Maryland).

The Board reported that there were 26,607 licensed physicians in Maryland during fiscal year 2009; that 485 certificates of merit records were added to the malpractice component of the data system, involving 660 physicians; that the Board generated 4,989 notices of malpractice claims and sent them to the hospitals, nursing homes and alternative health care organizations where the affected physicians had privileges; that the Board sent 683 letters to health care facilities informing them of disciplinary actions and or charges against 162 physicians who had privileges at their facilities; and, the Board levied fines against physicians during fiscal year 2009 in the amount of  $168,590.

Complaints to the Board increased in fiscal year 2009 over fiscal year 2008 (995 new complaints received in 2009 compared to 869 new complaints received during 2008). In fiscal year 2009, the Board received 699 consumer complaints and 296 complaints from other sources, for a total of 995 complaints.

There was a 2.2% increase in new physicians licensed in Maryland and a 20% increase in the number of medical school graduates that entered their post graduate training programs between fiscal year 2008 and fiscal year 2009.
